CJ suspension: 3-2 ruling gives me comfort to consider fresh legal challenge if… – Ekow Assafuah

The Member of Parliament (MP) for Old Tafo in the Ashanti region, Vincent Ekow Assafuah, has expressed his intention to file for a review of the Supreme Court’s recent ruling which dismissed his application for an injunction against the suspension of the Chief Justice(CJ), Her Ladyship Justice Gertrude Torkornoo.

The apex court on Tuesday, May 6, in a 3-2 majority decision, ruled against the MP’s motion to halt the process concerning the suspension and potential removal of the Chief Justice. President John Mahama, based on advice from the Council of State, had suspended the CJ.

Despite the outcome, Mr Assafuah insists that the close margin in the ruling underscores the legal weight of his arguments.

The court will on 21st May, 2025, offer reasons for the ruling.

According to the MP, “If you meet a bench, a five-member panel who says that the potency of your argument is apt, … and for that matter, I go with you, two of them, three saying that I disagree with you, this gives me some impression and it gives me some comfort that the reasoning for me going to court has merit and so if on the 21st of May I see the reason behind and I am not satisfied then I am likely to file for a review for the court to review its own decision,” he argued on JoyNews’ The Pulse after the Court ruling.

Former Attorney General, Godfred Dame, has also insisted that the Supreme Court’s decision against the injunction application demonstrates the legal merit of his challenge, despite the unfavourable outcome.
